Terms of Service

1. General
These terms of service, together with the Privacy Policy, your use of the 'Sleep Tracker' mobile application (the ”Application”) and related services provided by Ustinian Inc Limited (”Us”, ”We”).
By downloading and using the Application you agree to be bound by these terms of service. If you do not agree to these terms of service, do not use the Application.
2. Intellectual Property Rights
The Application and all related trademarks, logos, software and other intellectual property rights are and shall remain our exclusive property. Your right to use the Application and its content is personal, non-exclusive, non-sublicenseable and non-transferable. Any copying, republication or redistribution of the Application or any content is strictly prohibited.
3. Limitation of Liability
We shall not be liable for any errors in any content or for any actions taken in reliance thereon. Furthermore, we shall not be liable to you for any interception of online communications, software or hardware problems (including, without limitation, viruses, loss of data or compatibility conflicts).
4. Using the Application
Via the Application, users can select from a variety of options to create customized relaxation and self-improvement sessions. You can also use the paid functionality of the Application or purchase items that are offered for sale through the Application.
You understand and agree that the Services, Products and any other information you learn from Sleep Tracker are not intended, designed, or implied to diagnose, prevent, or treat any condition or disease, to ascertain the state of your health, or to be a substitute for professional medical care. Not all activities described or the Application are suitable for everyone. Any advice or other materials contained in the Application are intended for general information purposes only.
Do not use the Application while driving, operating heavy machinery, or performing other tasks that require attention and concentration. You understand and agree that you are solely responsible for your use of the Application.
5. Prohibitions
You agree not to do any of the following:
·Post, upload, publish, submit or transmit any Content that: (i) infringes, misappropriates or violates a third party’s patent, copyright, or other intellectual rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any person or entity; or (vii) promotes illegal or harmful activities or substances;
·Collect or store any personally identifiable information from the Application from other users of the Application without their express permission;
·Violate any applicable law or regulation.
You are solely responsible for all User Content that you post. Sleep Tracker is not responsible for User Content nor does it endorse any opinion contained in any User Content. You agree that if anyone brings a claim against Sleep Tracker related to User Content that you post, then, to the extent permissible under local law, you will indemnify and hold Sleep Tracker harmless against all damages, losses, and expenses of any kind (including reasonable attorney’s fees and costs) arising out of such claim.
6. Changes to this terms of service
We reserve the right to, from time to time, in our sole discretion amend these terms of service. It is your responsibility to review these terms of service from time to time to understand the extent of changes. Your continued use of the Application constitutes your agreement to the amended and updated terms of service.
7. Subscription Information
Sleep Tracker offers an auto-renewing subscription to provide you with unlimited access to the VIP features.Your payment will be charged to your iTunes Account as soon as you confirm your purchase. You can manage your subscriptions and turn off auto-renewal from your Account Settings after the purchase. Your subscription will renew automatically, unless you turn off auto-renew at least 24 hours before the end of the current period. The cost of renewal will be charged to your account in the 24 hours prior to the end of the current period. When canceling a subscription, your subscription will stay active until the end of the period. Auto-renewal will be disabled, but the current subscription will not be refunded. Any unused portion of a free trial period, if offered, will be forfeited when purchasing a subscription.
